Terms and Conditions
Please read these terms carefully before using our services

These Terms and Conditions ("Terms") govern your use of AWE Creative's services. By engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
1. Definitions
- "AWE Creative", "we", "us", or "our" refers to AWE Creative, an AI-first lead generation agency.
- "Client", "you", or "your" refers to the individual or entity engaging our services.
- "Services" refers to all services provided by AWE Creative, including but not limited to website design, AEO content creation, AI chatbot implementation, visitor identification, automated outreach, and related services.
- "Subscription" refers to the monthly subscription model under which our services are provided.
- "Contract Period" refers to the 24-month minimum commitment period, subject to cancellation rights after 3 months.
2. Services
AWE Creative provides AI-first lead generation services, including:
- • AI-optimised website design and development (included in subscription)
- • Monthly AEO (Answer Engine Optimisation) content creation
- • AI chatbot implementation using RAG (Retrieval Augmented Generation)
- • Visitor identification and tracking
- • Automated outreach sequences
- • Dynamic personalisation by sector
- • Monthly reporting and analytics
- • Technical maintenance and updates
Services are provided on a monthly subscription basis, starting from £1,999 per month. The website build is included in your subscription with no separate upfront fee.
3. Subscription and Payment
3.1 Subscription Model
Our services are provided under a monthly subscription model. The subscription includes all core services as outlined in your service agreement.
3.2 Contract Period
The minimum contract period is 24 months. However, you may cancel your subscription after 3 months if you are not satisfied with the services, subject to the cancellation terms set out in section 7.
3.3 Billing
Subscription fees are billed quarterly in advance. Payment is due within 14 days of invoice date. Late payments may result in suspension of services.
3.4 Price Changes
We reserve the right to adjust subscription fees with 30 days' written notice. Price changes will not apply to your current contract period but may apply to renewals.
4. Client Obligations
You agree to:
- • Provide accurate and complete information necessary for us to deliver services
- • Cooperate with our team and respond to requests in a timely manner
- • Ensure you have the necessary rights to any content, materials, or information you provide
- • Comply with all applicable laws and regulations
- • Not use our services for any unlawful or fraudulent purpose
- • Maintain the security of any login credentials or access provided
5. Intellectual Property
5.1 Website and Content
Upon full payment of all fees due, you will own the website design and content created specifically for you. However, we retain the right to use anonymised examples of your website and results for marketing purposes.
5.2 AEO Content
AEO content created for you is licensed for your use. We retain the right to create similar content for other clients, provided it is not identical to your content.
5.3 Our Intellectual Property
All proprietary systems, methodologies, software, and processes developed by AWE Creative remain our intellectual property. This includes but is not limited to our AEO methodology, visitor identification systems, and automation workflows.
6. Service Level and Performance
6.1 Service Delivery
We will use reasonable endeavours to deliver services in accordance with agreed timelines. However, delivery times are estimates and not guaranteed, particularly where they depend on your cooperation or third-party factors.
6.2 Results
While we use proven methodologies and best practices, we cannot guarantee specific results, lead volumes, or conversion rates. Results depend on various factors including market conditions, your industry, and your sales processes.
6.3 Website Availability
We aim for 99.5% uptime for hosted websites, excluding scheduled maintenance. We are not liable for downtime caused by third-party hosting providers or factors beyond our reasonable control.
7. Cancellation and Termination
7.1 Cancellation by Client
You may cancel your subscription after the initial 3-month period by providing 30 days' written notice. Cancellation requests must be sent to hello@awecreative.com.
7.2 Early Cancellation
If you cancel within the first 3 months, you remain liable for the full 3 months' fees. After 3 months, you may cancel without penalty, subject to the 30-day notice period.
7.3 Termination by Us
We may terminate services immediately if:
- • You breach these Terms and fail to remedy the breach within 14 days
- • You fail to pay fees when due
- • You use our services for unlawful purposes
- • You engage in conduct that damages our reputation or business
7.4 Effect of Termination
Upon termination, you will retain ownership of your website and content (subject to payment of all fees). We will provide reasonable assistance to transfer services to another provider, subject to payment of outstanding fees.
8. Limitation of Liability
To the maximum extent permitted by law:
- • Our total liability for any claim shall not exceed the total fees paid by you in the 12 months preceding the claim
- • We are not liable for indirect, consequential, or special damages, including lost profits or business opportunities
- • We are not liable for any loss arising from your failure to comply with these Terms or provide necessary information
- • We are not liable for changes to third-party platforms (e.g., Google, ChatGPT) that affect service delivery
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9. Data Protection and Privacy
We process personal data in accordance with UK GDPR and our Privacy Policy. By using our services, you consent to our processing of personal data as necessary to provide services.
You are responsible for ensuring you have appropriate legal basis for any personal data you provide to us, including visitor data collected through our tracking systems.
10. Confidentiality
We will keep confidential all information you provide to us, except:
- • Information that is publicly available
- • Information we are required to disclose by law
- • Information necessary to provide services (e.g., to third-party service providers under confidentiality agreements)
This obligation continues after termination of services.
11. Third-Party Services
Our services may integrate with third-party platforms and services. We are not responsible for:
- • Changes to third-party platforms that affect functionality
- • Third-party terms of service or privacy policies
- • Third-party service outages or failures
You may be required to accept third-party terms to use certain features of our services.
12. Changes to Terms
We may update these Terms from time to time. Material changes will be notified to you by email or through your account. Continued use of services after changes constitutes acceptance of the updated Terms.
Changes will not apply retroactively to your current contract period unless required by law or mutually agreed.
13. Disputes and Governing Law
These Terms are governed by English law. Any disputes will be subject to the exclusive jurisdiction of the English courts.
Before commencing legal proceedings, both parties agree to attempt to resolve disputes through good faith negotiation.
14. General
14.1 Entire Agreement
These Terms, together with your service agreement, constitute the entire agreement between us regarding the services.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.3 Assignment
You may not assign these Terms without our written consent. We may assign these Terms to any successor or affiliate.
14.4 Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, war, terrorism, or third-party service failures.
